Something that can and will be usurped by any government. No government has to be oppressive, all governments are oppressive by nature as the only crurency of politics is power. Every provision of our constitution has a weasel clause allowing government to ignore it. Why is a weasel clause needed and why were they inserted? At the end of the day no constitution is protected by anything but citizens desire and want of the rights afforded by the constitution. Our education system is designed to remove all appreciation of the constitution by citizens who now think it is the job of the laws,and courts to protect us and the constitution. We forget who controls absolutely the courts and constitution under such circumstances that nobody will object or object in sufficient numbers? Nor is there any provision to prevent an oppressive government from instilling its will on the people despite it being the second most requested inclusion. Not even one word of discussion by the drafters can be found. In truth the US constitution remains the best but fails to ensure proper education of the people to appreciate the rights given to them.

All our social ills despite our Constitution, can only be stopped by communities that are empowered by THEMSELVES, not by the promises of politicians. Where are we going wrong and why are we failing the next generation of leaders and people that should be carrying this country forward? Why did we make a mockery of our democracy by making Zuma president even after the rape allegations/corruption charges? Why do we celebrate people such as Julius Malema, why are influential criminals such as Shaick released from prison on questionable grounds? Why was Mogoeng Mogoeng appointed to the highest post in the judiciary with limited experience and a questionable track record? The executive and the country's president declaires but the judges are teaming up against declaring their interest. They need special previlages when declaring. That is unfair and unconstitutional. Normally the guy who won a case against the disburning of Scopion will not go on with the case unless he has been promised to drag it all the way to the constitutional court. This is not an inocent case to the constitutional court. our Judges need to be monitored including their movements. Some of then share beds with afriforum and da that is why political cases are easily won by this two organisations. One day the truth will come. The Constitution of the Republic of South Africa has been hailed globally as one of the finest pieces of progressive legislation ever produced. While studying Law at Rhodes, my colleagues and I were taught to view the Con-stitution with the utmost respect; to see the Constitution for what it really is: the crowning achievement of more than a century of struggle against tyrannical oppression and cruel discrimination. Yet, inasmuch as it is an achievement, our constitutional democracy is fragile and could be damaged by individuals or groups seeking to further their own interests, instead of addressing the far greater needs of the majority of our fellow citizens living in poverty. In a crisis, particularly one involving human rights violations, citizens and their legal advisors are quick to grab hold of every section of the Bill of Rights that may assist in correcting the injustice(s) they have suffered. Politicians eager to appear trustworthy and committed to those who elect them, will quote struggle heroes and heroines, whilst all the while, advocating policies or amendments which trample on the integrity of our constitutional democracy. We often seek the protection the constitution provides. Yet, we do little to ensure that its integrity is safeguarded and maintained. We, as citizens, have a sacred duty to do our utmost to protect the integrity of the constitution so that it may protect us in turn The people of the Rainbow Nation must be made aware that the Constitution is not the exclusive property of legislators, politicians, the judiciary or the organs of state which keep our country functioning. But in reality our Constitution is reactive, hundreds of billions are wasted but they have done very little. The HAWKS are merely an arm of the ANC, the Constitutional Court could of intervened sooner. It is laughable that the slogan is "We The People..." A centralization of the intelligence sector, further centralization of power by the executive and gross abuses on the part of the State go unchecked. When the people rise up the Constitution will be ripped up.

We're a bit bemused as to why some of the media won't hype this campaign given what we're trying to achieve - a demonstrable, mutually visible symbol of public support for the constitution. Hype is the only way we'll achieve the numbers we want. We have a very small budget and few resources. Most of the people who've worked on this campaign have done so for free. Since I've lived in Europe (in Holland, the UK and now Germany) I have been discriminated against, directly and indirectly, on the grounds of: marital status, social origin, age, sexual orientation and language! The European Eunion ironically adopted the South African Equality Clause in Article 21, word for word! But, whereas most South Africans know what the Equality Clause says, most Europeans I know don't even know that they have such a clause. The South African motto "Unity in Diversity" is another concept they have copied into the Charter of Fundamental Human Rights of the EU, adopted in Nice in 2000 (Article 22). My experience of discrimination in Europe actually showed me why it was important to write down the grounds on which discrimination may not be made. This experience taught me what it feels like to be discriminated against directly and indirectly. Highly ironic that a white male like myself had to experience discrimination in Europe to become aware how how dehumanising it is and how powerless it makes you feel. So I've become a Constitutionalist and have a framed copy of the South African Constitution on my wall to remind me of how far we are ahead of the Europeans! I can't wait for the day I go back to South Africa. I love my consitution!

Smith | | wethepeople.org.zaI have my doubts about the claims that RSA's Constitution is "the most advanced in the world" because section 9(2) recognises a concept called “restitutionary equality”: This "restitutionary equality" is associated with the political concept of “transformation” and therefore the Constitution implicitly contains commitment to transformation as process, towards the goal of an equal society, which means unequal treatment (of previously advantaged sections of the community) may/will have to be tolerated. This appears to entrench "unequal treatment" of the white male/female (ironically?) used in the newspaper advert despite the fact that they are too young to have been born pre-1994. Unfortunately this Constitutionally envisaged "transformation" process has ensconsed many corrupt, self-serving and fraudlent "transformers" in positions where they can waste resources and plunder the coffers thus destroying the best intentions of the Constitution.

As long as this remains, there is a genuine check to the abuse of power. The constitution's direct benefits to us, the people, do need, however, to be vigilantly monitored - it takes resources, will, commitment, on the part of the executive and administration to ensure that the pledges within the Constitution are carried out over time.
